These Terms and Conditions (“Terms”) govern your use of services provided by The Legendary Academy (“we,” “our,” or “us”), including personal training, coaching programs, memberships, digital content, and website use.
By purchasing, enrolling in, or participating in our services, you agree to these Terms.
1. Services
The Legendary Academy provides fitness training, coaching, programming, and related wellness services delivered:
- In person
- Online
- Through digital platforms or programs
Services are intended for general fitness and performance purposes and do not constitute medical advice.
2. Eligibility and Health Responsibility
You confirm that:
- You are physically able to participate in exercise
- You have disclosed relevant injuries, conditions, or limitations
- You will follow coach instructions and safety guidance
You agree to consult a qualified healthcare professional before starting training if you have medical concerns.
You participate at your own risk.
3. Assumption of Risk
Physical training involves inherent risks including, but not limited to:
- Muscle strain
- Injury
- Illness
- Aggravation of existing conditions
By participating, you voluntarily assume all risks associated with exercise and fitness activities provided by The Legendary Academy.
4. No Medical Advice
Information provided by The Legendary Academy, including coaching, programming, and content, is for educational and fitness purposes only and is not medical, physiotherapy, or rehabilitation advice.
You should seek professional medical guidance for diagnosis or treatment of health conditions.
5. Payments and Fees
All services must be paid for in advance unless otherwise agreed.
You agree that:
- Prices are listed in Canadian dollars unless stated otherwise
- Payments are processed through third-party providers
- You are responsible for all applicable taxes and fees
We reserve the right to change pricing with reasonable notice.
6. Memberships and Packages
Where applicable:
- Sessions or memberships are valid for the stated period
- Expired sessions may not be used unless extended by us
- Membership benefits are non-transferable
Specific package terms may be outlined at purchase.
7. Cancellations and Scheduling
We require advance notice for session changes or cancellations.
If you cancel:
- Within the required notice period → session retained
- Late or no-show → session may be forfeited
Exact notice windows may be communicated at booking or in program terms.
We may reschedule sessions due to coach availability, facility issues, or safety concerns.
8. Refund Policy
Unless otherwise stated:
- Services and training packages are non-refundable once purchased
- Used sessions are non-refundable
- Digital programs are non-refundable after access is granted
Exceptions may be made at our sole discretion or where required by law.
9. Client Conduct
You agree to:
- Act respectfully toward staff and clients
- Follow safety and facility rules
- Use equipment responsibly
- Not engage in disruptive or unsafe behavior
We may suspend or terminate services for misconduct without refund.
10. Results Disclaimer
Individual fitness results vary based on factors including effort, consistency, health status, and lifestyle.
We do not guarantee specific physical, performance, or aesthetic outcomes.
11. Intellectual Property
All materials provided by The Legendary Academy, including:
- Training programs
- Videos
- Documents
- Branding
- Website content
are owned by The Legendary Academy and protected by intellectual property laws.
You may not copy, share, distribute, or resell materials without written permission.
12. Limitation of Liability
To the fullest extent permitted by Canadian law, The Legendary Academy and its coaches, employees, and contractors are not liable for:
- Injuries sustained during training
- Health complications arising from participation
- Loss, damage, or theft of personal property
- Indirect or consequential damages
Our total liability is limited to the amount paid for the services in question.
13. Release
You release and discharge The Legendary Academy from claims arising from participation in training or use of services, except where prohibited by law.
14. Privacy
Your personal information is handled in accordance with our Privacy Policy.
15. Changes to Services
We may modify:
- Programs
- Coaches
- Schedules
- Facilities
- Service delivery format
where reasonably necessary to operate the business.
16. Termination
We may suspend or terminate services if you:
- Violate these Terms
- Fail to pay fees
- Engage in unsafe or abusive conduct
No refunds will be issued where termination results from breach.
17. Governing Law
These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.
